By accessing or using any VoIP-ZA (“we”, “us”, “our”) services, you (“User”, “Customer”, “Account Holder”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must discontinue use immediately.
1. Geographical Usage Restrictions
1.1 VoIP-ZA services are strictly licensed and intended for use within the Republic of South Africa only.
1.2 Any attempts to use the service outside South Africa, including through VPNs, proxies, tunneling, international routing, or other location-masking technologies, are strictly prohibited.
1.3 If such activity is detected, VoIP-ZA may immediately suspend or permanently cancel the account without prior notice, and no refunds will be issued.
2. RICA Compliance
2.1 In accordance with South African RICA legislation, all users must submit valid RICA documentation within 30 days or earlier of activating their account.
2.2 Accounts that fail to submit RICA documents within the required timeframe may be suspended or terminated without further notice.
2.3 All information submitted must be accurate, lawful, and verifiable.
3. Acceptable Use Policy (AUP)
Users may not use the Service for any illegal, abusive, or unauthorized activities, including but not limited to:
3.1 Prohibited Technical Activities
- Hacking, cracking, brute-force attempts, or attempting to bypass authentication controls.
- Manipulating SIP traffic, packet injection, spoofing, or call-spoofing.
- Using scanning tools, vulnerability testing tools, or attempting to access systems not part of your account.
- Overloading, flooding, or attempting denial-of-service (DoS/DDoS) activity.
- Distributing malware, spyware, viruses, worms, Trojans, or harmful code.
3.2 Prohibited Service Usage
- Fraudulent calls, premium-rate scams, toll fraud, robocalls, or automated dialing systems.
- Harassment, threatening calls, or illegal communications.
- Hosting or forwarding illegal, defamatory, or harmful content.
- Using VoIP-ZA services for any purpose that violates South African law.
VoIP-ZA may block, limit, or restrict access to any activity deemed suspicious, abusive, or non-compliant.
4. Fraud, Misuse & Customer Complaints
4.1 Any accounts found or suspected to be involved in fraud, suspicious activity, abuse, non-payment, or policy violations may be immediately suspended or permanently cancelled.
4.2 Valid complaints received from consumers, carriers, regulators, or legal authorities may result in immediate account suspension.
4.3 Where necessary, VoIP-ZA may report such incidents to law enforcement or relevant telecommunications regulators.
5. Security Monitoring & Enforcement
5.1 VoIP-ZA actively monitors network activity to protect users and infrastructure.
5.2 If any unauthorized access, hacking attempt, API abuse, password-guessing, or security breach is detected, VoIP-ZA may:
- Immediately suspend or terminate the account
- Disable SIP credentials, API keys, or portal access
- Block IP addresses, ports, or devices
- Report the incident to authorities
- Recover financial losses, investigative costs, or damages caused by the breach
5.3 No refunds are issued for accounts terminated due to security violations, fraud, or intentional misconduct.
6. Account Termination
6.1 VoIP-ZA reserves the right, at its sole discretion, to suspend or terminate any account that violates these Terms.
6.2 Termination may be performed without prior notice where serious misconduct, abuse, or illegal activity is suspected.
6.3 Upon termination, all rights to use the Service immediately cease.
6.4 The Customer remains liable for all charges accrued up to the date of termination, including costs associated with abuse or fraud.
7. Accuracy of Information
Users must provide accurate and up-to-date information when registering.
False or misleading information may result in immediate account suspension and possible legal action.
8. Liability & Indemnity
8.1 VoIP-ZA provides the Service “as is” without any warranties or guarantees.
8.2 We are not liable for:
- Loss of profit, revenue, business, or data
- Downtime or service interruptions
- Indirect, incidental, or consequential damages
- Damage caused by user negligence, hacking, or unauthorized access
8.3 Users agree to indemnify VoIP-ZA against any claims or damages resulting from:
- Breach of these Terms
- Illegal or fraudulent activities
- Security violations caused by the user or their devices
9. Changes to Terms
9.1 VoIP-ZA reserves the right to update or modify these Terms at any time.
9.2 Continued use of the Service after changes indicates acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any disputes will fall under the jurisdiction of the courts of Garden Route.
11. Acceptance of Terms
By using the VoIP-ZA Service, you confirm that:
You accept that violations may result in immediate account termination
You have read, understood, and accepted these Terms
You agree to comply with all legal obligations, including RICA
